Copyright is retained worldwide by the photographer at all times and nothing shall be deemed as a release, transfer, assignment or other disposal of the photographer’s copyright. You may not sell, publish, licence, copy, store digitally or otherwise distribute any of the images on this website without the written permission of the photographer. Terms of Sale
The following Terms and licensing conditions apply specifically to images purchased from the Shop on this website.
On completion of purchase – i.e. once full payment has been received by Ellie Pinney Studio Limited – the buyer is granted a non-exclusive, non-commercial, non-transferable, perpetual personal-use Licence to download and copy the purchased image (“The Image”), subject to the following restrictions:
- This Licence is for personal use only. Personal use means non-commercial use of The Image, for display on personal websites and computers, or making image prints for personal use. The Image may not be used in any way that involves you charging money, collecting fees, or receiving any form of remuneration / financial benefit for or from The Image (including, but not limited to, advertising, stock photography, print sale profits, commercial editorial use, or resale of any nature in either print or digital form).
- The Image may not be resold, relicensed, redistributed, or sub-licensed.
- The Image may not be altered or adjusted without express written permission from Ellie Pinney.
- The Image may not be used in an obscene, defamatory, immoral or illegal way.
- The Image may not be incorporated into trademarks or logos.
- The Image may not be used for competitions without express written permission from Ellie Pinney.
All rights, title and interest in The Image, including (without limitation) all copyright, patent, trademark, rights of publicity and other proprietary rights, are owned by, and shall remain exclusively with, Ellie Pinney.
There are no warranties, express or implied. The Image is provided “as is”.
Neither Ellie Pinney, nor Ellie Pinney Studio Limited will be liable for any third-party claims or incidental, consequential, or other damages arising out of this Licence, or the buyer's use of The Image. Your receipt of the downloaded files releases Ellie Pinney / Ellie Pinney Studio Limited from any obligation to maintain copies of any digital file, image or photograph.
The above permissions apply worldwide.
The above Licence agreement is governed by English law and any failure to comply with the terms may be dealt with as copyright infringement.
By purchasing and downloading The Image, you are agreeing to the above licensing terms.
